TERMS OF SERVICE
OVERVIEW
This website is operated by Terry Pottery, of 4 Bradstone Brook, Shalford, Guildford, Surrey, GU4 8HE, United Kingdom. Throughout the site, the terms "we", "us" and "our" refer to Terry Pottery. Terry Pottery offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
Nothing in these Terms of Service affects your statutory rights as a UK consumer under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Any new features or tools which are added to the current store shall also be subject to these Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least 18 years old, or that you have a parent or guardian's consent to use this site.
You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any UK laws (including but not limited to copyright laws).
You must not transmit any worms, viruses, or any code of a destructive nature.
A breach or violation of any of these Terms will result in immediate termination of your access to our Services.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time, provided this does not conflict with your statutory consumer rights.
You understand that your content (not including payment card information) may be transmitted over various networks and changed to conform to technical requirements. Payment information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.
SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We aim to keep information on this site accurate and up to date, but we do not guarantee that all material is complete or current at all times. Any reliance on material on this site is at your own risk. We reserve the right to modify the contents of this site at any time.
SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products may change, but any price change will not affect an order you have already placed and paid for.
We reserve the right to modify or discontinue the Service at any time.
SECTION 5 – PRODUCTS AND SERVICES
Certain products may be available exclusively online and may have limited quantities. These are subject to return or exchange in accordance with UK consumer law and our Returns Policy below.
We make every effort to display product colours and images accurately, but cannot guarantee your device's display will be fully accurate.
We reserve the right to limit the quantities of any products we offer, and to discontinue any product at any time.
SECTION 6 – YOUR RIGHT TO CANCEL AND RETURN GOODS
Under the Consumer Contracts Regulations 2013, if you are a consumer buying from us online, you generally have the right to cancel your order within 14 days of receiving your goods, without giving a reason, and to receive a refund. To cancel, please contact us at the email address below within this period. You will then have a further 14 days to return the goods to us. You are responsible for the cost of returning items unless they are faulty or not as described.
Important exception – personalised and made-to-order items: Because certain products we sell (such as personalised decoupage shells or custom-coloured wreaths) are made or personalised specifically for you, these items are exempt from the standard 14-day cancellation right under the Consumer Contracts Regulations 2013, once production has begun. This does not affect your rights if the item arrives faulty, damaged, or not as described.
If goods are faulty, not as described, or not of satisfactory quality, your rights under the Consumer Rights Act 2015 are not affected by anything in this section, and you may be entitled to a repair, replacement, or refund as appropriate.
SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse or limit any order, and to cancel orders that appear to be placed by dealers, resellers or distributors, or where fraud is suspected. You agree to provide accurate and complete purchase and account information, and to keep it updated.
SECTION 8 – OPTIONAL TOOLS
We may provide access to third-party tools which we do not control. Use of such tools is at your own risk, and you should review the relevant third party's own terms.
SECTION 9 – THIRD-PARTY LINKS
This site may contain links to third-party websites not affiliated with us. We are not responsible for the content, accuracy, or practices of any third-party website.

Occasionally, our site may contain typographical errors or inaccuracies relating to product descriptions, pricing, or availability. We reserve the right to correct these and to cancel orders affected by such errors, even after an order has been placed, and will notify you if this happens.
SECTION 13 – PROHIBITED USES
You are prohibited from using this site for any unlawful purpose, to harass or discriminate against others, to transmit malicious code, to collect others' personal information without consent, or to interfere with the security of the Service.
SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee that use of our Service will be uninterrupted or error-free. To the fullest extent permitted by law, we exclude liability for indirect or consequential losses arising from use of this site or our products.
This does not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded or limited under UK law. Nothing in this section affects your statutory rights as a consumer.
SECTION 15 – INDEMNIFICATION
You agree to indemnify us against any claims or costs arising from your breach of these Terms or your violation of any law or third-party rights, save where such claims arise from our own breach or negligence.
SECTION 16 – SEVERABILITY
If any provision of these Terms is found unlawful or unenforceable, that provision will be severed, and the remaining provisions will continue in full effect.
